David Gerk blames County Board for Chaos and Urges them to Stop Permitting

I wish it weren’t so but Arlington has chosen to self-inflict zoning approval chaos on itself.

Recently, 38 previously voided EHO permits magically flipped from “voided” to “approved” and the County is apparently accepting new EHO applications. But the EHO zoning case – Nordgren v County Board – sits actively appealed to the Supreme Court of Virginia. The Appeals Court decision in September remanded to the trial court to take on arguments from a further Party. It did not order the County to issue or accept EHO permits again. Only you did.
